Terms & Conditions

These Terms & Conditions ("Terms") form a legally binding agreement between
BatchBoard Technologies ("BatchBoard", "we", "us") and the
institution or individual ("you", "Customer") accessing or using BatchBoard's school management platform.
By creating an account or using the Service you agree to these Terms in full.
1. Definitions
- "Service" — the BatchBoard platform available at batchboard.in and its subdomains.
- "Customer Data" — all data uploaded, stored, or generated through your use of the Service, including student records, fee data, and attendance logs.
- "Authorised Users" — employees, staff, teachers, and other persons you authorise to use the Service under your account.
- "Subscription" — the paid or trial plan that grants access to the Service.
2. Account Registration
- You must provide accurate, complete information when creating your account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately at support@batchboard.in of any unauthorised access to your account.
- One account may be used by only one institution. Sharing accounts across multiple unrelated institutions is prohibited.
- You must be at least 18 years of age and authorised to bind your institution to these Terms.
3. Subscription & Payment
Free Trial
New accounts receive a free trial period as stated on the pricing page. No credit card is required during the trial. At the end of the trial, the account is downgraded to read-only unless a paid plan is activated.
Billing
- Subscriptions are billed monthly or annually in advance in Indian Rupees (INR).
- Payments are processed via Razorpay. Applicable GST will be added to all invoices.
- Invoices are sent to the registered billing email address.
- Prices are listed on the Pricing page and are subject to change with 30 days' notice.
Late Payment & Suspension
- If payment is not received within 7 days of the due date, we may suspend access to the Service.
- Data is retained for 30 days after suspension, after which it may be permanently deleted.
Refunds
Subscription fees are non-refundable except where required by applicable law. If you believe a charge was made in error, contact us within 7 days of the charge.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Upload false, misleading, or fraudulent student or financial data.
- Attempt to gain unauthorised access to our systems or another customer's data.
- Reverse-engineer, decompile, or create derivative works from the Service.
- Use automated bots, scrapers, or crawlers against the Service without our written consent.
- Resell or sublicense the Service to any third party.
- Send spam, phishing messages, or illegal content via the WhatsApp or messaging features.
- Upload or transmit malware, viruses, or any destructive code.
We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy without prior notice.
5. Data Ownership & Processing
- Your data is yours. You retain full ownership of all Customer Data at all times.
- You grant us a limited, non-exclusive licence to store and process Customer Data solely to provide the Service.
- We act as a data processor on your behalf under the DPDP Act, 2023. You are the data fiduciary responsible for ensuring lawful collection and use of student and staff data.
- You can export all your data at any time from the admin dashboard.
- We will never sell, rent, or use Customer Data for advertising or to train AI models without your explicit consent.
6. Intellectual Property
The Service, including all software, design, trade marks, and content created by BatchBoard, is owned by BatchBoard Technologies and protected by intellectual property laws. Nothing in these Terms transfers any IP rights to you. You may not use our name, logo, or branding without our prior written consent.
7. Confidentiality
Each party agrees to keep the other's confidential information (including Customer Data, pricing, and technical details) strictly confidential and not to disclose it to any third party without prior written consent, except as required by law. This obligation survives termination of these Terms for a period of 3 years.
8. Service Availability
We target 99.5% monthly uptime, excluding scheduled maintenance windows (notified 24 hours in advance). The Service is provided "as is" and we do not guarantee uninterrupted availability. Downtime caused by third-party providers (cloud host, payment gateways, WhatsApp API) is outside our control.
9. Limitation of Liability
To the maximum extent permitted by law:
- BatchBoard shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
- Our total aggregate liability to you for any claim arising out of these Terms shall not exceed the total fees paid by you in the 3 months immediately preceding the event giving rise to the claim.
- Nothing in these Terms limits liability for death, personal injury caused by negligence, or fraud.
10. Termination
- By you: You may cancel your subscription at any time from the admin dashboard. Access continues until the end of the current billing period. No pro-rata refunds are issued.
- By us: We may suspend or terminate your account immediately for material breach of these Terms, non-payment, or fraudulent activity. We may terminate without cause with 30 days' written notice.
- On termination, you have 30 days to export your Customer Data before it is permanently deleted.
11. Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved amicably. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bengaluru, Karnataka, India. The language of arbitration shall be English.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Your continued use of the Service after that date constitutes your acceptance of the revised Terms. If you do not agree, you may terminate your account before the effective date.
